Agreement

These terms are an agreement between you and Digital Infinity Group LLC ("we", "us") for your use of Homekcal, its phone app and website. By using Homekcal you agree to them. If you do not agree, do not use it.

Who can use it

You must be 18 or older. Homekcal is for personal, non-commercial use.

Estimates, not medical advice

Homekcal gives estimates of calories and nutrients. Estimates from a photo can be wrong by a lot, especially for oil, sauces and portion size, which is why they are shown as ranges. Check and correct them.

Homekcal does not give medical, dosing or medication advice, and it is not a medical device. It does not diagnose, treat or prevent any condition. Targets are suggestions worked out from an equation. Talk to a doctor or dietitian before changing how you eat, especially if you are pregnant, have a medical condition or take medicine that affects appetite or weight.

Your account

The app creates a private account on your phone when you start. Saving it with Apple, Google or an email code lets you keep your log on a new phone and is required before buying Pro, so the purchase can always be restored. Keep your sign-in secure; you are responsible for what happens in your account.

Free use and Pro

The free plan includes 3 photo logs a day, unlimited barcode, text and voice logging, targets and 7 days of history. Voice logging works on phones that can turn speech into text on the device (most iPhones, and Android 12 and newer where the phone supports it), because no audio is sent anywhere. Homekcal Pro costs $12.99 a year in the United States (other countries pay the store's local price) and adds unlimited photo logs, full history, trends and health sync (Apple Health on iPhone, Health Connect on Android 9 and newer).

"Unlimited" photo logs are subject to fair use of 15 a day and 300 a month, far above normal personal use, so that automated or shared use cannot run up costs for everyone. Barcode, text and voice logging are not affected.

Buying, renewal and cancelling

Homekcal Pro is sold only through the Apple App Store and Google Play. The store is the seller: it takes payment, charges any tax and handles renewals, cancellations and refunds under its own terms. In the European Union the seller is Apple Distribution International Ltd. or Google Commerce Limited.

Pro renews every year until you cancel. Cancel at least 24 hours before the renewal date in your store account (iPhone: Settings, your name, Subscriptions; Android: Google Play, Payments and subscriptions, Subscriptions). You keep Pro until the end of the year you paid for. Deleting the app does not cancel the subscription.

Refunds, and any right to withdraw from the purchase, are handled by the store under its terms; ask Apple or Google directly. If the price changes, the store tells you before your next renewal.

Your content

What you log is yours. You give us permission to store and process it only to run the service for you, as our Privacy Policy describes. You can export it or delete it at any time.

Acceptable use

Do not misuse the service: no reverse engineering beyond what the law allows, no automated or bulk access, no attempts to get around usage limits, no uploading anything illegal or anything that is not food, and nothing that interferes with other people's use.

Food data from others

Some nutrition data comes from USDA FoodData Central (public domain) and Open Food Facts (available under the Open Database License). We credit them wherever their data appears. Packaged food data can be out of date or wrong; check the label.

Our app

Homekcal, its name, design and software belong to Digital Infinity Group LLC. These terms give you a personal, revocable, non-transferable licence to use the app on devices you own or control.

Ending the agreement

You can stop at any time by deleting your account. We may suspend or end access for a serious or repeated breach of these terms, and will tell you why unless the law prevents it. If we ever shut the service down, we will give at least 30 days' notice and time to export your data.

Warranty and liability

The service is provided as it is. To the extent the law allows, we make no promise that it will be uninterrupted or that estimates will match what you ate, and our total liability to you is limited to the amount you paid for Pro in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law, or your statutory rights as a consumer, including rights you have in the EU and UK.

If you use the iPhone app

These terms are between you and us, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claim relating to the app, including product liability, legal compliance or intellectual property claims. If the app fails to conform to a warranty, you may notify Apple for a refund of its price, if any; Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Governing law

These terms are governed by the laws of the State of California, USA, without giving up any protection the law of your country of residence gives you as a consumer. You may bring a claim in the courts where you live.

Changes

If we change these terms in a way that matters, we will tell you in the app before the change takes effect.
